Thank you for visiting  This site is owned by Unleashed Fitness, LLC (“UF”).  Your privacy is important to UF.  This privacy policy (“Policy”) explains what personal data (“Personal Information”) UF collects from you and how UF uses it.


UF reserves the right to change this Policy from time to time without notice to you.  You acknowledge and agree that it is your responsibility to review this site and site policies periodically and to be aware of any modifications.  Your continued use of this Site after such modifications will constitute your acknowledgment of the modified Policy, and your agreement to abide and be bound by the modified Policy.


UF operates this website (“Site”) our mobile application on a mobile device (“App” or "Site") and the services and products related to or offered on the Site ("Services"). UF's Services may include, without limitation, tools, applications, email services, bulletin and message boards, chat areas, news groups, forums, communities, calendars, and downloadable mobile applications related to the Site or provided through the Site.


UF provides this privacy policy ("Policy") to help you understand the kinds of information UF may gather about you when you visit the Site or use any of our Services, how UF may use and disclose the information, and how you can control, correct and/or update the information.


"Personal Information" in this Policy means information that can be used to identify or contact a person, for example, a person’s full name, address, e-mail address, or phone number. The phrase "Anonymous Information" in this Policy means information that cannot reasonably be used to identify individual persons.


By visiting this Site or using the Services, you are accepting the policies and practices described in this Policy. Each time you visit the Site or use the Services, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy.


Your Personal Information will be processed by UF in the United States.


In addition to this general Policy, each Service may have additional privacy provisions that are specific to that particular Service. These additional provisions are disclosed adjacent to the particular Service at the time the information is collected and also govern the use of your information.


The Information Collected.  UF collects information to operate effectively and provide you the best experience with our Site and Services.


1.         Voluntary Information.


UF collects and maintains information that you provide directly via submission during your use of the Site, App, and/or Services.  For example:

            a.  during Site registration you may provide your name, email address, screen name, password, and demographic information;

            b.  you may add to your profile while using the Site’s social networking function by providing information about your interests;

            c.  when you register for a customized program, you may provide answers to questions;

            d.  to receive a newsletter, enter a contest, or participate in social networking activities, you may provide contact information such as email or physical address;

            e.  in order to purchase a product or service, you may provide UF your credit card information; and

            f.  while using email, customer support, or on-line surveys, you may provide UF with Personal Information.


You may always choose not to provide Personal Information or certain Personal Information, but this may prevent you from gaining access to a Service or limit the features that you can use on the Site.


2.         Passively and Automatically Collected Information


As you use the Site and/or Services, certain information may be passively and/or automatically collected.  UF may collect information by recording your Site use and how you use the Site n-personally identifiable information through, for example, cookies, pixels, beacons, log files, receiving reports or usage data, and other technologies.  For example:

            a.  determination of a location of particular computer or device though its IP address; and

            b.  information collected to allow delivery of more helpful and/or customized information, programs, tools, and advertisements.


UF may also automatically collect non-personally identifiable information throughout Internet Log files, which records data such as IP addresses, browser types, domain names, and other anonymous statistical data involving the use of the Site.  This information may be used for our business purposes, including personalizing your experience on the Site. 


Information is also collected when you use the App, including, for example:

            a. the software application needed to utilize the App;

            b. synchronization;

            c. non-personally identifiable information concerning your device;

            d. the application’s files on your device; and

            e. your usage of the App;.


3.         Information Received from Third Parties


Information may be received from third parties, online and/or offline, and may be combined with the information UF has already collected from you through our Site and/or Services.  The information received from third parties may be used for a variety of purposes.  For example:

            a.  verify other information about you, including your mailing address; and

            b.  to enhance or customize content provided to you.


How UF Uses Your Information.  UF will use your Personal Information in the ways described below or described at the time that the information is collected.


1.         Providing Site and Services

 UF uses the information UF collects to provide you the Services UF offers, which includes:

            a.  improving the Site and/or Services, and personalizing your experiences;

            b.  communicating with you, for example, informing you about your account, our services, and product information;

            c.  administering your account;

            d.  registering you for access to the Site and providing Services;

            e.  fulfilling Service orders;

            f.  sending promotional information, newsletters, offers, or other information; and

            g.  analyzing and conducting research on user data and user interactions with the Site and/or Services.


2.         Advertising

UF uses the information UF collects to provide advertising that UF shows you more relevant to you.  Advertising may be customized based upon:

            a.  the information that you provide (e.g., age, gender, stated health interests and other information in your profile);

            b.  geographic location information, which UF may determine through your IP address, from your mobile device, or other ways;

            c.  data UF receives from third parties; or

            d.  your visits on the Site or use of Services.


UF DOES NOT use what you say in email, chat, video calls or voice mail, or your documents, photos or other personal files to target ads to you.


Cookies and other technologies.  Web traffic information is  gathered on the Site via “cookies.”  Most sites use cookies.  Cookies, small pieces of digital information stored by your browser on your computer, are small text files that can be read by a web server in the domain that put the cookie on your hard drive. They track initial and returning visits, browsing patterns on the Site, and Services ordered and/or viewed.  UF cookies do not contain personally identifying information, but enable UF to identify you as a repeat visitor and may help UF personalize your Site experience.  UF may also use cookies, pixels, web beacons (which are usually small, transparent graphic images), operating system, and device information and navigational data like Uniform Resource Locators (URL) to gather information regarding:

            a.  store your preferences and settings;

            b.  enable you to sign-in;

            c.  provide interest based advertising;

            d.  fight fraud;

            e.  analyze Site operations;

            f.  provide and/or analyze our Services; and

            g. collect  data about the date and time of your visit, the features and information for which you searched and viewed, the email you opened, on which advertisements you clicked or your IP Address.


UF does not store Personal Information in any cookies on your computer.  UF may also use web beacons to help deliver cookies and gather usage and performance data about our Services. Our Services may include web beacons and cookies from third-party service providers..


Although most browsers are initially set up to accept cookies, you may reset your browser to notify you when you receive a cookie or to reject cookies generally.  There are a variety of tools to control cookies, web beacons, and similar technologies, including for example, browser controls to block and delete cookies and controls from some third-party service providers to opt out of data collection. Your browser and other choices may impact your experiences with our Services.  Cookies may be removed by following your Internet browser’s directions with the help tab, however, in order to use certain Services offered on the Site your web browser must accept cookies. If you choose to disable cookies, some aspects of the Site may not work properly, and you may not be able to access our Services.


Flash cookies, local stored objects, may be used on certain features of the Site to collect and store information about your preferences and navigation to, from, and on the Site.  Flash cookies are not managed by the same browser settings as cookies, and they are not placed on your computer.

Web beacons, pixel tags, or clear GIF, are graphic images which are used to better understand the browsing patters of visitors to a page of the Site. They may be used on some pages of the Site by UF or third parties.  Web beacons DO NOT pass or read personally identifiable information about you.  When HTML code for a web beacon points to the Site to retrieve the pixel image, information can be passed along such as:

            a. the IP address of the computer that requested the image;

            b. the time the web beacon was viewed;

            c. how long the web beacon was viewed;

            d. the type of browser that was used; and

            e. previously set cookie values.


Web beacons work in conjunction with cookies set by trusted third parties that are used to assess, for example, the effectiveness of particular promotional campaigns, or to optimize advertising once a user leaves the Site. Please view your browser’s help section to determine how to configure your browser to reject or manage UF and/or third-party cookies. UF may share aggregated information collected through web beacons to vendors for which the beacon was set to determine the success of marketing campaigns, but does not disclose personally identifying information to these vendors.

Third parties may track anonymous Site usage through cookies and web beacons on the Site and other websites. They do this by setting a cookie (or reading a cookie previously placed by them) on users’ computers to track the activities of users who view a web page that contains web beacons. Third parties ad servers may use information about your visits to the Site and other websites in order to provide advertisements about goods and services that may be of interest to you. Periodically, upon our request, third parties may report the anonymous data that they collect on our behalf back to UF for our internal use and analysis and our treatment of this anonymous data is governed by the terms of this Privacy Policy. UF does not control these advertisers or other parties' use of cookies or web beacons or what they do with the information they collect.


To learn more about targeted advertising, these providers, or how you may opt out or to learn more, please refer to Network Advertizing Initiative (NAI) and/or the Digital Advertizing Alliance (DAA) at NAI Opt-Out website and DAA Choice Page and follow the instructions. After you opt-out, you will still see advertisements, but the advertising may not be as relevant to your interests. If you change your computer, change your browser or delete your cookies, you will need to renew your opt-out.  Technologies other than http cookies may be used by third-parties in a similar way, to recognize the email recipients’ computer or device and to keep track of which user identities match to which devices or browsers, and those technologies may not respond to browser settings that block conventional cookies. You may opt out of many of these types of technologies by visiting the NAI’s opt out page as well


Reasons UF May Disclose Personal Information.  UF may share your Personal Information with third parties as specifically approved by you or for the reasons described below. If you do not want UF to use or disclose Personal Information collected about you in the ways identified in this Policy, you should not use the Site or Services.  UF shares your personal data with your consent or as necessary to complete any transaction or provide any service you have requested or authorized. UF also shares data for legal reasons, with our affiliates, agents and contractors, with vendors working on our behalf; to maintain the security of our Services; and to protect the rights or property of UF. Access to your Personal Information by service providers is limited to the information reasonably necessary to perform its limited function.  You acknowledge that such transfers may occur and are permitted by this Policy.


1.         Disclosure for Legal Reasons

UF may disclose your Personal Information to third parties:

            a.  to comply with valid legal requirements; or

            b.  in special cases, such as a physical threat to you or others, a threat to homeland security, a threat to our system or network; or

            c.  in any cases in which UF believes it is reasonably necessary to investigate or prevent harm, fraud, abuse, illegal conduct or a violation or alleged violation of this Policy or other agreement UF may have with you.


2.         Disclosure to Affiliates, Agents, and Contractors.

UF may share your Personal Information with:

            a.  any of our subsidiaries, joint ventures, or other companies under common control; or

            b.  in the event UF goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred; or

            c.  UF may also provide your Personal Information to service providers who work on our behalf or help UF to operate our business, the Site, the Services, and administer activities on our behalf; or

            d.  UF may share your information (other than payment information) with third parties for shipping and billing purposes.


3.         Anonymous Information

 UF may share aggregated Anonymous Information about Site users, customers, sales, traffic patterns, and related Site information  with third parties. Aggregated information is your Anonymous Information that is combined with the Anonymous Information of other users.


4.         Contests and Polls

Some or all of the information collected during a contest, polls, promotions or sweepstakes (“Contests”) may be disclosed publicly. It may also be shared with other third parties as disclosed at the time of collection or in the Contest rules. These third parties may include providers of prizes in order to update you of your status of your prize or other fulfillment needs or a co-sponsor who may use your Personal Information to administer the Contest or for their marketing purposes, but only in conformance with their privacy policy as made available to you at the time of collection. UF is not responsible for their privacy policy or practices.  When you participate in a Contest, you are subject to any official rules for that Contest, which may contain additional information about the specific privacy practices associated with the Contest.


5.         License Services

UF may operate part or all of theSite on behalf of others (“ Licensors”) and UF may share some or all of your Personal Information with its Licensors.  This Policy does not cover the use of your Personal Information by Licensors.  The privacy practices of UF’s Licensors may differ from this policy and you should contact those third parties directly if you have questions regarding their use of your Personal Information.


6.         Others

UF may share your Personal Information you provide when you register for the Site or Services with sponsors, advertisers, Merchants or others.  No current advertisers will receive registration information UF may collect Personal Information about you and share it with third parties to the extent that you five use permission at the time of collection.  UF may also sometimes gather Personal Information on behalf of a sponsor in association with a Contest.  In such cases, UF will provide you notice at the time of collection.  The privacy practices of third party advertisers, sponsors, and merchants may differ from this Policy.  UF does not control and are not responsible for how these third parties use your information.


Mobile Devices/Third-Party Fees.  UF may make mobile device applications and mobile marketing campaigns available to you and may allow you to register for services that involve messages and/or emails being sent to your mobile device. You are responsible for obtaining access to the mobile device services. Such access may involve third-party fees, including mobile carrier, text messaging, or airtime charges. You are solely responsible for those fees, including any and all fees associated with the use of the applications, delivery of the messages, emails or other materials to your mobile device. Please consult your mobile service provider’s pricing plan prior to purchasing or downloading any application or registering for any such service to determine the charges for sending and receiving text messages from/to your mobile device. You will be given the opportunity to opt-in to receive text messages or emails to your mobile device at the time you register for the campaign and with each message or email you receive.

Mobile marketing campaigns may involve your sending an email from your mobile device to UF or a third-party campaign operator. An email or other response will then be sent to your mobile device. Opting to participate in a campaign is 100% your choice. When you engage in these mobile marketing campaigns, UF and the third-party campaign operator may collect your cell phone number, the name of your wireless service provider, images that you send using your cell phone as part of the campaign, and other relevant information.

Message Boards, Social Media, Blogs, and Chats.  UF may make message boards, bulletin boards, chat rooms, social media pages, blogs, and other interactive forums (“Forums”) available as part of the Services. Forums give users the opportunity to interact with each other.  Forums may be moderated to help keep inappropriate message from being posted.  You should be aware that any information which you post to these interactive Forums, or otherwise choose to make publicly available, including your Personal Information, may be disclosed and available to all users who have access to that portion of the Site or Services. You may be offered the opportunity to include your email address with your message, but you are not obligated to do so. Please keep in mind that whenever you voluntarily disclose personal information through or on these Forums your information can be viewed, collected and used by others. In short, if you post personal information in a Forum that is accessible to the public, you may receive unsolicited messages from other parties in return. We cannot control the actions of any third-parties.  By using these interactive Forums, you agree that UF is not responsible for any information that you disclose or communicate in such forums, and any disclosures you make are at your own risk. By posting any comments, pictures or other information ("Content") in a Forum hosted by UF, you grant UF a non-exclusive, irrevocable, perpetual and worldwide right to copy and post both such Content within our Site, and those of our parent, affiliates, subsidiaries, assigns, agents and licensees and any social media outlets and advertising medium through which we are engaged or elsewhere on the Site, without any further notice to you or any remuneration therefore.


Conduct on Site.  Your use of the site is subject to all applicable laws and regulations, including Netiquette, and you are solely responsible for the contents of your communications service, chat room, message board, news group, software library, or other interactive service that may be available to you on or through this Site.  You agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content that:

            1. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortuous, contains explicit or graphic descriptions or accounts of sexual acts;

            2. victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;

            3. infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;

            4. constitutes unauthorized solicitation, or any form of lottery or gambling;

            5. contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; or

            6. impersonates any person or entity, including any of our employees or representatives.


UF neither endorses nor assumes any liability for the contents of any material uploaded or submitted by third party users of the Site.  UF generally does not pre-screen, monitor, or edit the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through this Site.  However, UF reserves the right at our sole discretion to remove any content that UF deems harmful, objectionable, or inaccurate.  UF is not responsible for any failure or delay in removing such content.


Minor's Personal Information.  The Site and Services are not directed to nor intended for minors, in particular, children under 13 years of age. UF does not knowingly collect Personal Information from individuals under 13 years of age. If you are under 13 years of age, you should not register or provide Personal Information on the Site or through the Services. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to UF, please contact UF at so that UF may delete and remove such child's information from our systems.  Any unauthorized use terminates the permission or license granted by UF.


Your Consent and Notification of Change.  By using the Site or App, you consent to the collection and use of your information by UF. If you do not want to receive additional promotions from UF, please let UF know by unsubscribing. If you do not agree to the terms of this Privacy Policy, you should not use our Site or App.

If at some point in the future, there is a change to our information usage practices that affect your personally identifiable information, UF will notify you by email or by posting the change on the Site. Accordingly, you should check this posted Policy for changes. All amended terms automatically take effect 30 days after they are posted. Also, depending on the nature of the change, you may have the option to opt-out of the new information usage.  You should check this posted Policy for changes each time you enter the Site.

Controlling Your Personal Information.  You have choices regarding the collection, use, and sharing of your Personal Information. When you receive communications from UF you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the e-mail or newsletter you receive, or by editing your preference to receive these communications when you are logged in as a registered user on the Site. If you opt-out of promotional or newsletter emails from UF, we may continue to send you certain transactional communications, such as service announcements and administrative messages relating to your account with UF, which are necessary to our relationship with you.

If your Personal Information changes or if you no longer desire to use or access the Site or Services, UF encourage you to correct, update or remove the Personal Information from your profile. This can be done at the "Profile" or "My Account" or similar section on the Site. After you delete or change information from your profile, UF may retain your Personal Information in conformance with our data retention policy and Personal Information may remain within our databases, access logs, and other records. In addition, UF is not responsible for updating or removing your Personal Information contained in the lists or databases of third parties who have been provided information as permitted by this Policy.


Third Party Links.  The Site or portions of the Site may link to websites operated by third parties that UF does not control. UF does not monitor, control, or endorse the information collection, use, dissemination, or privacy practices of any third parties. UF encourages you to become familiar with the privacy practices regarding any data or Personal Information provided by, or obtained from users of these websites.  These websites will be governed by their policies.  Please read the policy for every website you visit and contact them if you have any questions about their respective privacy policies and practices. This Policy applies solely to information collected by UF through the Site or Services and does not apply to these third party websites. The ability to access information of third parties from the Site or Services, or links to other websites or locations, is for your convenience only and does not signify our endorsement of such third parties, their products, services, websites, locations or their content.


User’s Materials.  Subject to this Policy, any communication or material that you transmit to this Site by any means for any reason, will be treated as non-confidential and  non-proprietary.  While you retain all rights in such communications or material, you grant UF and our designated licensees a non-exclusive, paid-up, perpetual, and worldwide right to copy, distribute, display, perform, publish, translate, adapt, modify, and otherwise use such material for any purpose regardless of the form or medium (now known or not currently known) in which it is used.


Security.  Protecting your security is important to UF.  UF takes reasonable security measures to help protect the data, including Personal Information, on our servers. UF also uses the industry’s standard secure server software Secure Socket Layer (SSL) encryption on the Site. SSL is state of the industry technology that encrypts Personal Information transmitted over the Internet. Unfortunately, no one can guarantee the security of an internet transmission, and therefore, UF does not warrant the security of our servers or the security of information you provide to UF online, including Personal Information.

International Use.  Although this Site may be accessible worldwide, UF makes no representation that materials on this Site are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited.  Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws.  Any offer for any product, service, and/or information made in connection with this Site is voice where prohibited.


Termination of Use.  You agree that UF may, in our sole discretion, terminate or suspend your access to all or part of the Site with or without notice and for any reason.  Any suspected fraudulent, abusive, or illegal activity may be grounds for termination and may be referred to appropriate law enforcement authorities.

Governing Law.  This site is controlled by UF from our offices within the State of Colorado, United States of America.  It can be accessed from all fifty states, as well as from other countries around the world.  As each of these places has laws that may differ from those of Colorado, by accessing this site you and UF agree that  the statutes and laws of the State of Colorado, without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of this Site and the Services available through this Site.


License to Use Site.  UF grants you a personal, limited, non-exclusive and revocable license to access and make personal use of this Site.  However, you acknowledge that all the features on this Site, including without limitation the design, graphics, text, sounds, pictures, software, scripts, and other files are the property of UF and/or its licensors, and are protected by United States and international copyright, trademark, and other intellectual property laws.  All ownership rights are reserved to UF and/or its licensors.  You may access these materials only for your person, noncommercial use.  You may not download from (other than page caching) or modify the Site, except with express written consent of UF.  This license does not include any resale or commercial use of this Site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this Site or its contents; any downloading or copying of account information for the benefit of another merchant, or any use of data mining, robots, or similar date gathering and extraction tools.  This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of UF.
